Scope These General Terms and Conditions apply to all orders placed via the online shop of: Severine Holzwarth Maison Worst Case Neulinggasse 21 1030 Vienna Austria Email: sevi@maisonworstcase.com The seller operates as a sole proprietor (Einzelunternehmerin) under Austrian law.
Eligibility Orders may only be placed by persons of legal age (18 years or older) who possess full legal capacity.
Contract Conclusion By placing an order, the customer submits a binding offer to purchase the selected product. The contract is concluded upon written order confirmation by the seller. Automatic order confirmations do not constitute acceptance of the contract.
Products & Custom Production All products are made to order. Colors are freely selectable. Each piece is individually produced according to the customer’s selection and therefore qualifies as a custom-made product. Custom sizing is available upon request. Measurements are taken in person at the atelier in 1030 Vienna. Custom sizing is subject to a 20% surcharge. Due to the handmade nature of latex garments, slight variations in color, finish, or structure may occur.
Prices All prices are stated in EURO. As a small business under Austrian law (Kleinunternehmerregelung), no VAT is charged. The seller reserves the right to adjust prices in case of obvious errors.
Payment Methods The following payment methods are accepted: Credit Card, PayPal, Apple Pay, Google Pay, Cash payment (in case of in—person purchase at the atelier) Payment is due immediately upon order confirmation.
Shipping Shipping conditions: Austria: free shipping European Union: flat rate of €25 Currently, no regular shipping is offered outside the European Union. Customers outside the EU may contact the seller via the contact form for individual arrangements.
Delivery Time Since all items are made to order, the delivery time is approximately 3–5weeks. In exceptional cases, delivery times may vary.
Right of Withdrawal According to § 18 FAGG (Austrian Distance and Off-Premises Contracts Act), there is no right of withdrawal for goods that are: not prefabricated, individually manufactured, or clearly tailored to personal needs. As all products of Maison Worst Case are made to order and individually produced, the right of withdrawal is excluded.
Returns Returns are only accepted in case of proven material defects. Return shipping costs are borne by the customer.
Retention of Title The goods remain the property of the seller until full payment has been received.
Liability The seller is liable only for damages caused by intent or gross negligence. Liability for slight negligence is excluded except in cases of personal injury.
Applicable Law & Jurisdiction Austrian law applies. Place of jurisdiction is Vienna, Austria.
